Terms of Service.

By using mintsouq.com (the "Service"), you agree to these Terms. The Service is operated by Mint Capital Investment LLC, a company registered in Dubai, UAE.

1. Eligibility

You must be at least 18 years old (or the age of majority in your country, whichever is higher) to register. By creating an account, you confirm that all information you provide is accurate and that you're not acting on behalf of a sanctioned entity.

2. Your account

• You're responsible for everything that happens on your account. Don't share your password.
• One person, one account. Multiple accounts to circumvent verification or bans is grounds for termination of all related accounts.
• You must verify your email before posting listings. Phone and ID verification unlock additional features (badges, high-value escrow).

3. Listings — what you can and can't post

You can post legitimate items and services for sale, rent, or exchange. You may not post:

• Anything illegal under UAE law or the law of the country where the listing is located.
• Counterfeit, stolen, or recalled goods.
• Firearms, ammunition, regulated chemicals, or any controlled substances.
• Live animals where prohibited; endangered species under any circumstance.
• Adult content, sexual services, or anything sexualising minors.
• Items that infringe trademarks, copyrights, or patents.
• Misleading content (stock photos passed off as your item, fake testimonials, false "as good as new" claims).
• Spam, duplicates, or repeated re-posts of the same listing.

Mint Souq reserves the right to remove any listing that violates these terms or that we judge to be harmful to the marketplace, with or without notice.

4. Mint Souq Escrow

The optional escrow service operates as follows:

• Buyer transfers funds to the Mint Capital escrow client account.
• Funds remain there until the buyer confirms receipt of the item, after which we release the funds to the seller.
• The fee is a flat 5% of the transaction value, deducted from the seller's payout. Buyers pay nothing extra.
• Escrow funds are held in a segregated client account at our partner bank. They are not Mint Capital's operating funds and are protected accordingly.
• Disputes are resolved by Mint Souq's resolution team based on evidence from both parties. We aim to resolve within 5 business days.
• If the buyer does not respond within 7 days of seller-confirmed delivery, funds auto-release.

5. Verification & identity

By submitting a government ID for verification, you authorise Mint Capital Investment LLC to:

• Verify the document's authenticity, including (where applicable) cross-referencing with public databases.
• Store the document images in encrypted storage for the duration of your account plus a retention period detailed in our Privacy Policy.
• Disclose the documents to law enforcement, regulators, or financial-investigation authorities upon a lawful request connected to a fraud, money-laundering, or other financial-crime investigation.

You confirm that the documents you submit are genuine and belong to you. Submitting forged or stolen identity documents is a criminal offence under UAE Federal Law and will result in account termination and reporting to the police.

6. Fees and payments

• Posting basic listings is free.
• Sponsored listings (Featured, Sponsored, Category Sponsor) carry the prices shown at checkout. Prices are exclusive of VAT where applicable.
• Escrow fees are 5% flat as described above.
• All fees are non-refundable once a sponsored period has started or escrow has been initiated.

7. Conduct

Don't be a jerk. Specifically:

• No harassment, hate speech, or threats in messages between users.
• No attempts to scrape, reverse-engineer, or load-test the platform without permission.
• No use of the platform to facilitate illegal payments or sanctions evasion.
• No impersonation of Mint Souq staff, public officials, or other users.

8. Intellectual property

You keep ownership of the content you upload (listing photos, descriptions, profile info). By uploading, you grant Mint Capital Investment LLC a worldwide, royalty-free licence to display, distribute, and modify that content within the Service. The Mint Souq name, logo, design, and source code are owned by Mint Capital Investment LLC and may not be reproduced without permission.

9. Limitation of liability

Mint Souq is a marketplace — not the seller of the items listed (except where explicitly stated, e.g. our own ads or sponsored placements). We are not party to the transactions between users beyond what we provide through the escrow service.

To the maximum extent permitted by UAE law, our liability for any claim arising from your use of the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.

10. Termination

You can close your account at any time from your dashboard. We can suspend or terminate accounts that violate these terms, with cause. On termination, your active listings are removed and any escrow funds are returned to the appropriate party per the relevant transaction's status.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Disputes shall be resolved in the courts of Dubai, unless another jurisdiction has exclusive competence under UAE law.

12. Changes

We may update these Terms as the product evolves. Material changes are emailed to registered users at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
